Family: spouse and unmarried children under 21 in L-2 status; L-2 spouses are employment-authorised

Who it suits: parent with a US degree-level job offer

Main requirements

Bachelor's degree or equivalent for a specialty occupation; most new cases need a selected electronic cap registration (lottery).

Family: H-4 for spouse/children

F-1 student visa at a private K-12 school

Who it suits: child attending an SEVP-certified private school (e.g. boarding schools)

Main requirements

SEVP can certify private schools for F-1 in any K-12 programme; public schools only grades 9-12 for max 12 months.

Family: no derivative status for parents

School: Private schools are the normal F-1 route.

E-2 treaty investor

Who it suits: nationals of treaty countries investing in a US business

Main requirements

Must be a national of a treaty country. The US enterprise must have the treaty country's nationality: at least 50% owned by persons with that nationality. The investment must be substantial and sufficient to ensure the enterprise operates successfully; uncommitted or revocable funds in a bank account or similar security are generally not considered an investment. The enterprise must be real, operating and commercial, and must generate more than a living for the investor and family or have a significant economic impact in the US. A principal investor must be coming to develop and direct the enterprise; others must be coming as supervisors, executives or with specialised skills essential to its efficient operation. Must intend to depart when E-2 status ends. No minimum dollar amount is stated. (Same page: E-3 is for Australian nationals in a specialty occupation.)
